Know Your Rights Under the Texas Data Privacy and Security Act

In its last legislative session, the Legislature passed the Texas Data Privacy and Security Act, which grants Texans greater control over their personal information and ensures that businesses handle that data responsibly.

This law empowers Texans with new privacy rights, including the ability to: 

  • Know what personal information businesses collect, use, and share about them. 
  • Correct inaccuracies in your personal information. 
  • Delete your personal information held by a business. 
  • Opt out of targeted advertising, the sale of their personal data, or profiling decisions. 

Businesses subject to the law must provide a clear privacy notice on their websites that explains: 

  • What types of personal information they collect and process and why. 
  • The personal information shared with third parties and the type of third parties involved. 
  • Whether they sell sensitive personal information. 
  • How consumers can exercise their rights to access, correct, or delete their personal information.
